These Terms of Service ("Terms") govern your access to and use of the websites, applications, and digital products offered by NA Digital Health, operated by Nickolas Lima Andrade (CPF 119.710.076-84), with registered address at Rua Wilson Teixeira, 820, Jardim Panorama, Ipatinga-MG, 35164-246, Brazil ("we", "us", "our"). By purchasing, accessing, or using any of our products, you ("Customer", "you") agree to be bound by these Terms.
1. Products and Services
NA Digital Health is a portfolio of digital wellness products, including interactive web applications, educational programs, recipe systems, and structured routines. All products are delivered electronically — no physical goods are shipped. Products are intended for personal, non-commercial use by the individual purchaser.
2. Eligibility
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to purchase our products. By placing an order you represent that the information you provide is accurate and that you have the legal capacity to enter into this agreement.
3. Account Registration
Some products require account creation. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at nickolas.andrade@hotmail.com of any unauthorized access.
4. Pricing, Payment and Billing
- All prices are displayed on each product's sales page in the applicable currency and include all mandatory taxes unless otherwise stated.
- Payments are processed by Stripe, a PCI-DSS Level 1 certified payment processor. We do not store full card numbers on our servers.
- Charges appear on your statement as "NA DIGITAL HEALTH" or a similar descriptor associated with Nickolas Lima Andrade.
- One-time purchases are charged once at checkout. Subscription products, when applicable, are clearly labeled with renewal frequency and may be cancelled at any time before the next billing cycle from your account dashboard.
5. Digital Delivery
Upon successful payment confirmation, access credentials and product links are delivered immediately by email and within your customer dashboard. Typical delivery time is under five (5) minutes. If you have not received access within one (1) hour, contact nickolas.andrade@hotmail.com.
6. License of Use
We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the purchased products for your own wellness purposes. You may not resell, redistribute, sublicense, publish, reverse-engineer, or create derivative works from any of our materials.
7. Refunds
We offer a 7-day satisfaction guarantee. Refund conditions and procedure are described in our Refund Policy, which is incorporated into these Terms by reference.
8. Health Disclaimer
NA Digital Health products provide informational and educational content related to wellness, nutrition, skincare, and daily routines. They do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any new wellness, dietary, or skincare regimen, especially if you are pregnant, nursing, taking medication, or have a pre-existing medical condition.
9. Acceptable Use
- Do not use our products for any unlawful, harmful, or fraudulent purpose.
- Do not attempt to disrupt, attack, or gain unauthorized access to our systems.
- Do not share your account or distribute downloaded materials.
10. Intellectual Property
All content, branding, designs, code, text, graphics, and trademarks displayed on our websites and applications are the exclusive property of Nickolas Lima Andrade or licensed to him, and are protected by Brazilian and international copyright law.
11. Limitation of Liability
To the maximum extent permitted by applicable law, NA Digital Health and its operator shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, our products. Our total aggregate liability shall not exceed the amount paid by you for the specific product giving rise to the claim in the twelve (12) months preceding the event.
12. Modifications
We may update these Terms from time to time. Material changes will be communicated by email or via a notice on our website at least seven (7) days before they take effect. Continued use after the effective date constitutes acceptance.
13. Termination
We may suspend or terminate your access if you breach these Terms, engage in fraudulent activity, or initiate an unjustified chargeback. You may stop using our services at any time by contacting support.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute shall be submitted to the courts of the District of Ipatinga, State of Minas Gerais, Brazil, except where consumer-protection law requires otherwise.
